Preamble
These general terms and conditions of sale (GTCS) are entered into between, on the one hand, the company Leurre de la pêche, registered at R.C.S Bordeaux, Siren n° 452 373 137, registered office: 108 avenue du lac, 33990 HOURTIN, France hereinafter referred to as "Leurre de la pêche"
and, on the other hand, persons wishing to make a purchase via the Leurre de la pêche website https://www.leurredelapeche.fr/gb/ hereinafter referred to as "the user".
Prior to any transaction, the user acknowledges having read and expressly accepts these terms and conditions.
The parties agree that these GTC, available on the day of purchase, exclusively govern their relationship. In the absence of any other condition, it will be deemed to be governed by current practice in the distance selling sector applicable in France. The company undertakes to comply with the legislative provisions in force and in particular all the provisions of the Consumer Code relating to distance selling.
The purpose of these GCS is to define the terms and conditions of sale applicable between Leurre de la pêche and the user, from the placing of the order to after-sales services, including payment and delivery. These conditions apply exclusively to non-trading individuals.
Order
Any user of the site who does not have a customer number must follow a registration procedure to obtain a customer number. This number is personal.
Any order implies acceptance of the prices and description of the products available for sale.
The user has the possibility of modifying his basket before the final validation, this last step formalising the sales contract between Leurre de la pêche and the user. leurre de la pêche undertakes to honour orders received on the website only within the limits of available stocks of products. If a product is not available, Leurre de la pêche undertakes to inform the user as soon as possible.
In certain cases, notably non-payment or incorrect address, Leurre de la pêche reserves the right to block the user's order until the problem has been resolved.
For any questions relating to the tracking of your order, the user should contact customer service.
Delivery
- The delivery of a product ordered on Leurre de la pêche will be carried out at the customer's choice within the options proposed for the products concerned by the customer's order either by La Poste or by a specific carrier. For parcels sent outside mainland France, the basis for calculating shipping costs will be that provided by the Post Office.
- Delivery is made to the address provided by the customer on the form filled in by the customer at the time of ordering. The delivery address must be a physical address (number / street). Leurre de la pêche reserves the right to refuse any delivery to a post office box.
Leurre de la pêche shall not be held liable for any failure to fulfil its contractual obligations in the event of force majeure or unforeseen circumstances, and in particular natural disasters, fires, internal or external strikes, internal or external failures or breakdowns, and in general any event preventing the proper execution of orders.
It is the user's responsibility to check their parcel on arrival. They have 48 hours in which to inform us of any observations concerning non-compliant delivery.
If the customer wishes their order to be delivered to more than one location, they will have to place as many orders with the associated delivery charges.
For reasons of product availability, an order may be delivered in several instalments to the customer, who will only pay the delivery charges shown on the order form once.
An order comprising several products, some of which may be temporarily unavailable or permanently out of stock, may be dispatched without the missing reference(s). The customer will then be informed as soon as possible by the customer service department of the missing references.
The customer will then have the choice of :
- have the amount of the missing products credited to the customer's account in the form of a credit note, to be automatically deducted from the next order.
- request the replacement of the missing products with other available products sold by Leurre de la pêche; in this case, if this replacement results in a price difference, each party undertakes to pay the other the difference; the customer in the form of an additional order with the price already paid for the missing products deducted by Leurre de la pêche by bank transfer or cheque;
- request a full refund for the missing products from Customer Services in the form of a bank transfer or cheque.
In the event that the products ordered are subject to different weight times, the weight time applicable to the said order will be the longest.
Delivery times are given in working days.
Prices
Prices are given in euros, inclusive of all taxes. these prices do not include a flat-rate contribution to processing costs (postage, packaging and preparation of the parcel in accordance with the amounts in force) and delivery costs.they take into account the VAT applicable on the day of the order. Any change in the applicable rate may be reflected in the prices of the products. However, prices cannot be modified once the customer's order has been validated.
The prices indicated on the site are guaranteed for the duration of the online publication and within the limits of available stocks.
The user will also be required to pay a lump sum to cover the costs of processing and delivering the order, the amount of which will be specified on the order form before the order is validated. This contribution is calculated according to the products ordered.
Payment
Users may choose to pay for their purchases :
- online when ordering by credit card: Carte Bleue, e-cartebleue, Visa, Mastercard, American Express
- online with their PayPal account: by choosing payment via PayPal, users are automatically directed to their PayPal account.once the PayPal payment has been validated, the customer completes the order on the Leurredelapêche.fr website
- by cheque: in this case, the order will be reserved for 7 days. After this period, if the cheque is not received, the order will be cancelled. The order will not be processed until the cheque has been received and validated.
Concerning payments with Alma en 10x :
Payment by credit is available for the settlement of their purchases via our partner Alma, the execution of the payment is conditioned by the signature of the credit contract offered by Alma. The Seller accepts in advance the granting of credit concluded between Alma and the customer in accordance with article L312-46 of the Consumer Code. If Alma agrees to grant credit to the Customer, the amount will be paid by credit in accordance with article L312-45 of the Consumer Code. Any refusal by Alma to grant credit for an order may result in the cancellation of the order, unless the customer agrees to pay cash. Any cancellation of the GTC binding the Seller and the customer will result in the cancellation of the credit contract between Alma and the customer. In the event of retraction, the Customer's costs and interest will be reimbursed in accordance with the regulations.
Security: Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure. Alma is a tele-payment manager and issues an electronic certificate as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the French Civil Code
Special case: In the case of a contract for the sale or provision of services with successive performance or delivered over a fairly long period of time, the Seller must specify in its GTCS the time of commencement of delivery or supply. Right of withdrawal / exchange
In accordance with Articles L.121-20 et seq. of the French Consumer Code, the customer has a period of 14 working days from the date of delivery of the order to return any item in its original packaging and in good condition, fit for re-sale, undamaged and accompanied by any accessories, instructions and documentation, as well as the delivery invoice, and request an exchange or refund without penalty, with the exception of the cost of returning the item.
Returns are subject to obtaining a file number. To open this returns file and receive the applicable terms and conditions, a request must be made by the customer to the relevant department, specifying whether an exchange or refund is required.
Returns by cash on delivery will not be accepted.
Returns without first opening a returns file will not be accepted.
In the event of a customer exercising their right of withdrawal, Leurre de la pêche is obliged to reimburse the sums paid by the customer, free of charge, with the exception of the cost of returning the goods within a maximum period of 15 days.
In the event of an exchange request by a customer, if the new order is for a higher amount, the customer must enclose payment for the balance with the exchange request. Conversely, if the amount of the exchange is less than the initial amount, the customer will be reimbursed the difference by bank transfer or cheque.
Guarantees
All items are subject to a legal guarantee and in particular a guarantee against hidden defects (articles 1641 et seq. of the French Civil Code), it being the customer's responsibility to provide proof of the hidden defect.
Leurre de la pêche undertakes to describe the products sold on the website as accurately as possible. However, Leurre de la pêche may not be held liable in the event that the non-performance of its obligations is attributable either to the unforeseeable and insurmountable act of a third party to the contract or to a case of force majeure as defined by the standards in force. Similarly, Leurre de la pêche shall not be held liable for any inconvenience or damage inherent in the use of the Internet.
On-line payment
In all cases, the online provision of the bank card number and the final validation of the order shall constitute proof of the completeness of the order and shall constitute payment of the sums involved by the entry of the items appearing on the order form. this validation shall constitute signature and express acceptance of all operations carried out on the site. However, in the event of fraudulent use of the customer's bank card, the customer is invited, as soon as this is discovered, to contact the customer service department and the bank.
Personal data
Leurre de la pêche reserves the right to collect data on the user, in particular through the use of cookies. The collection of data by Leurre de la pêche, the data controller, is necessary to process the user's requests.
By providing Leurre de la pêche with an e-mail address, the user may receive an order confirmation. Depending on the choice made when creating or consulting his/her account, the user may receive offers from Leurre de la pêche as well as offers from other commercial partners, by e-mail, telephone or SMS as indicated when creating the account.
In accordance with Article 32 of Law No. 2004-801 of 6 August 2004 on the protection of individuals with regard to the processing of personal data and amending Law No. 78-17 of 6 January 1978 on data processing, data files and individual liberties, each user has the right to access, modify and delete information concerning him or her at any time by contacting Leurre de la pêche either directly on the Internet in his or her customer area or by post by writing to : Leurre de la pêche Customer Service, 108 avenue du Lac, 33 990 HOURTIN, France, stating your surname, first name, e-mail address and, if possible, your customer reference number.
The user is informed that this automated processing of information, in particular the management of e-mail addresses, has been declared to the CNIL under number 141 50 62 dated 1 March 2010.
Leurre de la pêche makes every effort to ensure the confidentiality and security of data transmitted over the web. To this end, the website uses a secure method of payment.
Intellectual property rights
All elements of the Leurre de la pêche site, whether visual or audio, including the underlying technology, are protected.
Any user who has a personal website and who wishes to place, for personal use, on his or her site a simple link referring directly to the Leurre de la pêche site must request prior authorisation from Leurre de la pêche.
Entirety, applicable law and jurisdiction
These General Terms and Conditions and any agreement between Leurre de la pêche and its customer are governed by French law.
In the event of a dispute, the parties will always seek an amicable solution. In particular, the customer should first contact the Leurre de la pêche customer service department to obtain an amicable solution.
In the event that one of the clauses of this contract should become null and void as a result of a change in legislation, regulations or a court ruling, this shall in no way affect the validity of and compliance with these general terms and conditions of sale.
